    WHAT CONSTITUTES CRUELTY

    Impossible to explain the full spectrum of legislation relating to animals here, it is nevertheless important that some aspects relating to common offences be explained, relating to cruelty and neglect.

    It is an offence by any person who:

    Overloads, overdrives, overrides, ill-treats, neglects, infuriates, tortures or maims or cruelly beats, kicks, goads or terrifies any animal or

    Confines, chains, tethers or secures any animal unnecessarily or under such conditions or in such a manner or position as to cause that animal unnecessary suffering or in any place which affords inadequate space, ventilation, light, protection or shelter from heat, cold or weather; or

    unnecessarily starves or under-feeds or denies water or food to any animal:

    being the owner of an animal, deliberately or without reasonable cause or excuse, abandons it, whether permanently or not, in circumstances likely to cause that animal unnecessary suffering.

    It is advised to contact a SPCA Inspector concerning uncertainty relating to legal matters and animals.
