ANIMALS AND THE LAW
The SPCA strives for the
happy co-existence between people and animals. Therefore
any matter that effects such a relationship is of interest
to the SPCA. However as the animals do not have the voice
to speak, the SPCA will speak on their behalf and defend
their rights whenever needed. More so in cases where
animal’s rights not to be neglected, abused or being
cruel to are being violated.
All animals, domestic, farm
and wildlife are protected by Acts of Parliament, namely
the Animals Protection Act No 71 of 1962 and the
Performing Animals Protection Act No 24 of 1935.
Transgression of any of these Laws constitutes a Criminal
offence and people found guilty under these acts will have
a criminal record. The SPCA will not hesitate to prosecute
any person who willfully and/or maliciously causes an
animal to suffer.
In addition to
Parliamentary legislation, local By-Laws and ordinances
are in place regulating the ownership of animals within
Municipal boundaries. The SPCA works closely with Local
Councils in the drafting and implementation of these
regulations. The changing new South Africa has brought
about the need to update and revise many of these
regulations and this is at present being done.
Sadly as is so often the
case, most people do not know the Law and the SPCA goes to
great lengths to inform and educate the public on the Law
how it relates to animals.
